Abuse by Teachers

Courts have found that teachers and school boards owe fiduciary duties to children based on the relationship of trust between student and teacher. When a child is abused by a teacher, it can have a significant negative impact on the child's education, which in turn can negatively impact employment. In one case where a student was sexually abused by a school teacher, the Court recognized the significant measure of power and authority a teacher has over students.
